The Argument from Less Divorce

Fallacy: Divorce rate in Massachusetts has dropped substantially since State law there permitted same-sex marriage. So same-sex marriage is good for a State, in part because it decreases the divorce rate.

Allegedly, inheritance Federal taxes should not be required from legally married same-sex spouses, because the USA Constitution prescribes due process for all USA citizens.

Allegedly, opposition to same-sex civil marriage is largely due to religious bigotry against couples of homosexual behavior.

Allegedly, opposing same-sex marriage is unconstitutional because Federal Judge Tauro, and President Obama through his administration's Department of Justice has declared the Defense of Marriage Act (DOMA), Section 3 to be unconstitutional, and will not defend it (though it will enforce it [sometimes]).

Allegedly, approving same-sex civil marriage will not "hurt" opposite-sex marriages. (This argument is usually posed as a question, without explaining what is meant by "hurt".)

Allegedly, opponents of same-sex civil marriage are bigots because they exclude same-sex couples from the institution of marriage, and all the benefits that such an institution affords to married couples.

Allegedly, Nationwide polls show that most US Americans agree to include same-sex couples into their State or Federal definition of marriage.
